本約款は、株式会社インフキュリオン（以下「当社」といいます）が発行するプリペイドサービス（以下「Coke ON Wallet」といいます）のご利用（Coke ON Walletへの入金、残高確認及びCoke ON Walletによる商品購入を含む）について規定するものです。利用者（以下「お客様」といいます）は、本約款及び日本コカ・コーラ株式会社が別途定めるCoke ON利用規約の定めに従ってCoke ON Walletを利用するものとします。なお、Coke ON利用規約の定めと本約款の定めとの間に齟齬があるときは、本約款の内容が優先して適用されるものとします。

本約款において使用する用語の定義は、別途定義されない限り、以下のとおりとします。

Coke ON Walletは、Coke ON Pay対応自販機での本件商品購入にご使用いただけます。Coke ON Pay対応自販機の設置場所については、Coke ONアプリにて検索していただくことが可能です。

• 1. 

  Coke ON Walletは、当社がお客様に対し、Coke ONアプリにおいてバーチャルに発行するものとします。

• 2. 

  当社は、Coke ON利用規約および本約款へご同意いただいたお客様に対してのみ、Coke ON Walletを発行します。

• 3. 

  おひとり様に対して複数のCoke ON Walletを発行することはできません。

• 1. 

  Coke ON Walletは、登録画面から電話番号、氏名、氏名カナ、メールアドレスおよびパスワードを登録することによりご利用可能となります。お客様は当該パスワードを秘密として管理してください。お客様はパスワードを、お客様の責任により管理し、他人に知られることのないように十分ご注意ください。

• 2. 

  お客様がパスワードを失念した場合、当社所定の方法に従い、パスワードを再設定していただきます。

• 3. 

  Coke ON マネーもしくはCoke ON ポイントが盗取、偽造もしくは変造された場合、またはお客様の許可なくパスワードが第三者に使用された場合であっても、そのために生じた損害について、当社は責任を負いません。

• 1. 

  Coke ON マネーへのチャージは、当社の指定する金融機関が提供する決済サービスまたは日本コカ・コーラ株式会社が指定する自動販売機により、繰り返し行うことができます。

• 2. 

  Coke ON マネーへの1回あたりのチャージ額は200円からとなります。

• 3. 

  Coke ON マネーの残高上限額は3万円です。

• 4. 

  Coke ONポイントは、Coke ONアプリにログインの上で、Coke ONポイントキャンペーンに参加することで付与されます。付与されたCoke ONポイントは、Coke ON Walletに利用登録をすると、1ポイント=1円分として、本件商品の購入に利用することができます。

• 5. 

  Coke ONポイントの残高上限額は270,000円です。

当社は、お客様からの同意を得た上で、連携先金融機関口座の振込依頼・振込指図の伝達を行います。当社は、電子決済等代行業再委託者として、電子決済等代行業者に対し業務の委託を行うものであり、連携先金融機関を代理する権限を有しません。また、当社が行う電子決済等代行業再委託者としての業務は、連携先金融機関が行うものではありません。

• 1. 

  Coke ON Walletを用いて本件商品を購入する場合は、Coke ON Pay対応自販機とCoke ONアプリを、日本コカ・コーラ株式会社が指定する方法によって接続のうえで使用するものとします。この場合、Coke ON Wallet残高から本件商品額を差し引くことにより、金銭にて本件商品購入対価をお支払いただいた場合と同様の効果が生じます。

• 2. 

  Coke ON マネーとCoke ON ポイントを合算して利用することは可能です。その場合、Coke ON ポイントから優先して利用されます。

• 3. 

  Coke ON Walletを用いて本件商品を購入する場合、商品購入額がCoke ONアプリ上に表示されますので、お客様はその内容に誤りがないことを確認するものとします。

• 4. 

  Coke ON Wallet残高が本件商品購入合計額に満たない場合、他の決済手段残高と合算して本件商品を購入いただくことができます。Cole ON Wallet残高と他の決済手段残高の合計が本件商品購入合計額に満たない場合、Coke ON Walletを用いて本件商品を購入いただくことはできません。

• 5. 

  お支払の際に複数のCoke ON Walletをご使用いただくことはできません。また、Coke ON Walletを複数お持ちであっても、各Coke ON Wallet残高を統合することはできません。

お客様は、Coke ON Wallet残高について、払い戻しを受けることができません。但し、当社が、社会情勢の変化、法令の改廃、その他日本コカ・コーラ株式会社または当社の都合によりCoke ON Walletの取扱いを全面的に廃止する旨を決定した場合は、例外的に、当社に対して、「資金決済に関する法律」に定める方法において払い戻しを求めることができるものとし、このとき当社は、同法が定める方法でCoke ON Wallet残高を確認したうえで、お客様に対して払い戻しを実施します。

当社は、お客様がCoke ON Walletを紛失した場合、盗難された場合、またはお客様の許可なく第三者が使用した場合であっても、Coke ON Walletならびに記録されているCoke ONマネーおよびCoke ONポイントの再発行はいたしません。なお、Coke ON Walletの不正利用に関する補償については、「Coke ON Wallet補償制度に関する約款」に定めるとおりとします。

• 1. 

  お客様が次のいずれかに該当するときは、当社はCoke ON Walletのご利用をお断わりし、お客様に対する通知等をすることなく当然にCoke ON Walletを失効させることができるものとします。

  • (1)

    お客様が、不正な方法によりCoke ON Walletを取得もしくはチャージし、または不正な方法により取得もしくはチャージされたCoke ON Walletであることを知って使用した場合

  • (2)

    Coke ON Walletが改竄、偽造、または変造等されたものである場合

  • (3)

    キャンペーンなど販売促進ツールとして利用する目的で発行する場合

  • (4)

    再販等の営利目的で購入する場合

  • (5)

    本約款またはCoke ON利用規約に違反した場合

  • (6)

    その他、Coke ON Walletが不正に利用されたと当社が判断する場合

• 2. 

  前項各号の疑いがある場合、当社は調査のため、お客様に対する通知等をすることなく、一時的にお客様のCoke ON Walletの利用を停止できるものとします。

• 3. 

  前各項に基づいてCoke ON Walletが失効または一時的に利用停止となった場合、当社は当該Coke ON Walletの交換・再発行・返金等には一切応じません。

• 1. 

  お客様は、自己または自己の親族が、現在、以下のいずれにも該当しないことを表明し、かつ将来にわたっても該当しないことを確約するものとします。

  • (1)

    暴力団

  • (2)

    暴力団員および暴力団員でなくなったときから5年を経過しない者

  • (3)

    暴力団準構成員

  • (4)

    暴力団関係企業

  • (5)

    総会屋等、社会運動等標ぼうゴロまたは特殊知的暴力集団等

  • (6)

    前各号の共生者

  • (7)

    その他前各号に準ずる者

• 2. 

  お客様は、自己または自己の親族が自らまたは第三者をして、以下のいずれの行為も行わないことを確約するものとします。

  • (1)

    暴力的な要求行為

  • (2)

    法的な責任を超えた不当な要求行為

  • (3)

    取引に関して脅迫的な言動をする、または暴力を用いる行為

  • (4)

    風説を流布し、偽計を用いもしくは威力を用いて当社の信用を毀損し、またはその業務を妨害する行為

  • (5)

    その他前各号に準ずる行為

• 3. 

  お客様が前二項各号のいずれかに違反している疑いがあると判断した場合、当社は、何らの通知、催告なしに、直ちに当社が違反している疑いがあると判断した者によるCoke ON Wallet残高またはアカウントの利用を停止するなど当社と当該お客様との間に存在する本規約に基づく契約を含む一切の契約の全部または一部につきその債務の履行を停止することができるものとし、契約の全部もしくは一部につき締結を拒絶することができるものとします。

• 4. 

  お客様が第1項または第2項に違反した場合（以下本条において違反した者を「該当者」といいます）、当社は、何らの通知、催告なしに、直ちに該当者が保有するCoke ON Wallet残高を失効させる、及び該当者のアカウントを閉鎖することができ、また、当社と該当者との間に存在するすべての契約の全部または一部につき、何らの責任を負うことなく、その債務の履行を停止し、または解除することができるものとします。

• 5. 

  該当者は、当社に対するすべての債務（本規約に基づく債務に限定されないものとします）について、当然に期限の利益を失い、当社に対し直ちに債務全額を現金にて支払わなければならないものとします。

• 6. 

  第4項に基づく措置は、当社による損害賠償の請求を妨げないものとします。

Coke ON Walletに関するシステムの設計・管理には万全を期しておりますが、停電、システム障害、メンテナンス、Coke ON Walletの不正利用防止等に対する安全管理、その他やむをえない事情により、当社は予告なくCoke ON Walletのご利用内容の一部または全てにつき一時的に停止できるものとします。その際、Coke ON Walletがご利用いただけないことからお客様に不利益または損害が生じた場合でも、当社に故意又は重過失がある場合を除き、当社は一切の責任を負いません。

Coke ON Walletへの質権等担保権の設定はできないものとします。お客様が本規定に違反したことによりお客様に不利益または損害が生じた場合でも、当社は一切の責任を負いません。

• 1. 

  Coke ON マネーの残高の有効期間は、最終入金日または最終利用日のうち、新しい日から起算し、36ヶ月後の月末までとなります。

• 2. 

  Coke ONポイントの残高の有効期間は、原則としてポイントが付与された日から起算し、12ヶ月後の月末までとなります。ただし、別途有効期限のあるポイントについては、その期間が経過すると失効します。また、Coke ON Walletの利用登録をされていないお客様においては、Coke ONポイント残高の有効期限はポイントが付与された日の翌月末までとなり、当該ポイントの有効期間中に利用登録を完了した場合には当該ポイントの有効期限がポイント付与日から12か月後の月末まで延長されます。

お客様は、当社所定の方法によりCoke ON Walletを退会することができます。この場合、当社所定の期間が経過したときに、本規約に基づくお客様たる地位（以下「お客様資格」といいます。）が喪失され、Coke ON Walletの利用ができなくなります。なお、当該退会までにお客様がCoke ON Wallet残高を使い切っていない場合、当社は当該Coke ON Wallet残高をゼロとすることができ、また、現金の払戻しも行いません。
Coke ON WalletはCoke ONと一体のサービスであるため、Coke ONのアプリ利用終了をしたユーザのみ、Coke ON Walletを退会することが可能です。Coke ONアプリの利用終了については、Coke ON 利用規約第6条をご参照ください。

• 1. 

  当社は、以下の各号のいずれかに該当する場合は、本約款を変更することができるものとします。

  • (1)

    本約款の変更が、お客様の一般の利益に適合するとき

  • (2)

    本約款の変更が、本約款による契約をした目的に反せず、かつ、変更の必要性、変更後の内容の相当性及びその内容その他の変更に係る事情に照らして合理的なものであるとき

• 2. 

  当社は、本約款を変更しようとする場合、変更後の本約款の効力発生日を定め、変更後の本約款の内容およびその効力発生日について、Coke ON アプリもしくはCoke ON Walletに関するウェブサイトまたはプッシュ配信その他当社所定の方法により、お客様に周知するものとします。

• 3. 

  前項の定めによって周知した効力発生日に本約款は変更され、お客様と当社との間で変更後の約款の効力が有効に発生するものとします。

• 1. 

  本約款は日本国法に準じて解釈されるものとします。

• 2. 

  本約款は、日本語の言語により作成されたものであり、それに基づき解釈されます。翻訳は参考目的です。本規約の定めと訳文との間に齟齬があった場合には、日本語版のものが優先するものとします。

These Terms describe rules regarding the use of the prepaid service (“Coke ON Wallet”) issued by Infcurion, Inc. (the “Company”) (including deposits to Coke ON Wallet, balance confirmation, and purchases of products with Coke ON Wallet). The user (“Customer”) shall use Coke ON Wallet in accordance with these Terms and also the provisions of the Coke ON Terms of Use separately prescribed by Coca-Cola (Japan) Company, Limited. In the event of a discrepancy between the Coke ON Terms of Use and these Terms, the contents of these Terms shall prevail in application.

The definitions of terms used in these Terms shall be as follows, unless they are separately defined.

Coke ON Wallet may be used to purchase Products at Coke ON Pay Compatible Vending Machine. The locations of Coke ON Pay Compatible Vending Machines can be searched in Coke ON App.

• 1. 

  Coke ON Wallet shall be virtually issued by the Company to Customer through Coke ON App.

• 2. 

  The Company shall only issue Coke ON Wallet to Customer who has consented to Coke ON Terms of Use and these Terms.

• 3. 

  Multiple Coke ON Wallets cannot be issued to a single person.

• 1. 

  Coke ON Wallet can be used by registering phone number, name, name (kana), an e-mail address and password. Customer shall keep the password confidential. Customer shall manage the password at their own risk and take adequate care not to make it known to others.

• 2. 

  If Customer has forgotten the password, it may reset the password following the method prescribed by the Company.

• 3. 

  Even if Coke ON Money or Coke ON Points are stolen, forged or altered, or a password is used by a third party without the permission of Customer, the Company shall not be liable for losses incurred from same.

• 1. 

  Charging of Coke ON Money may be conducted repeatedly using the payment services provided by the financial institutions designated by the Company or using the vending machines designated by the Coca-Cola (Japan) Company.

• 2. 

  The minimum amount of each Charging of Coke ON Money is JPY 200.

• 3. 

  The maximum balance of Coke ON Money is JPY 30,000.

• 4. 

  Coke ON Point can be granted by participating in the campaigns after log in to the Coke ON app. The Coke ON Point can be used as 1 point = 1JPY for purchasing the Products after registration for Coke ON Wallet.

• 5. 

  The maximum balance of Coke ON Point is JPY 270,000.

With your consent, the Company will transmit transfer requests and instructions for linked bank accounts. We act as an electronic payment agency subcontractor and do not have the authority to represent these linked financial institutions. The services the company provides as an electronic payment agency subcontractor are not performed by the linked financial institutions themselves.

• 1. 

  To purchase Products using Coke ON Wallet, Coke ON Wallet shall be used after connecting Coke ON Pay Compatible Vending Machine to Coke ON App in the manner designated by Coca-Cola (Japan) Company, Limited. In this case, the same effect as payment of consideration to purchase Products in cash shall be achieved by deducting the amount for the Products from Coke ON Wallet Balance.

• 2. 

  Coke ON Money and Coke ON Points may be used in combination. In this case, Coke ON Points shall be used first.

• 3. 

  When purchasing Products using a Coke ON Wallet, the amount of the product purchase will be shown on Coke ON App, and Customer shall confirm that there is no error in the contents.

• 4. 

  If the Coke ON Wallet balance is less than the total purchase amount of the Product, you can combine it with the balance of other payment methods to purchase the Product. If the total of the Coke ON Wallet balance and the balance of other payment methods is less than the total purchase amount of the Product, you cannot purchase the Product using the Coke ON Wallet.

• 5. 

  Multiple Coke ON Wallets may not be used for a payment. Even if more than one Coke ON Wallet is held, Coke ON Wallet Balances cannot be combined.

Customer may not receive a refund of Coke ON Wallet Balance; provided, however, that if the Company has decided to entirely abandon the handling of Coke ON Wallet due to changes in societal conditions, revision or abolition of laws or regulations, or other circumstances of Coca-Cola (Japan) Company, Limited or the Company, Customer may exceptionally request that the Company refund in the manner prescribed by the ” Payment Services Act”, in which case the Company shall provide a refund to Customer after confirming the balance in the manner prescribed by the Company.

Even if Customer has lost a Coke ON Wallet or had it stolen, or it has been used by a third party without the permission of Customer, the Company shall not re-issue the Coke ON Wallet or the recorded Coke ON Money or Coke ON Points. Compensation for unauthorized use of a Coke ON Wallet shall be handled as provided in the “Coke ON Wallet Compensation Program Terms.”

• 1. 

  The Company may refuse the use of a Coke ON Wallet, and may automatically invalidate the Coke ON Wallet without any notice, etc. to Customer, if any of the following applies to Customer:

  • (1)

    Customer has acquired or conducted Charging of a Coke ON Wallet through improper means, or has used it with the knowledge that the Coke ON Wallet was acquired or charged through improper means.

  • (2)

    The Coke ON Wallet is falsified, forged, altered, etc.

  • (3)

    It was issued for the purpose of use for a sales promotional tool such as a campaign.

  • (4)

    It was purchased for resale or other commercial purposes.

  • (5)

    There has been a violation of these Terms or the Coke ON Terms of Use; or

  • (6)

    The Company has otherwise determined that a Coke ON Wallet was improperly used.

• 2. 

  If there is a suspicion of any of the foregoing, the Company may temporarily suspend the usage of the Coke ON Wallet by Customer for investigation purposes without notice, etc. to Customer.

• 3. 

  If a Coke ON Wallet has been invalidated or use has been temporarily suspended pursuant to the previous paragraphs of this Article, the Company shall not exchange, re-issue, refund, etc. of the Coke ON Wallet.

• 1. 

  Customer represents that it and its family do not constitute any of the following, and covenants that they will not constitute any of the following in the future.

  • (1)

    A criminal organization

  • (2)

    A criminal organization member or person who ceased to be a criminal organization member within the past 5 years

  • (3)

    A criminal organization quasi-member

  • (4)

    A criminal organization-affiliated enterprise

  • (5)

    A shareholder meeting racketeer, social movement racketeer, criminal organization specialized in intellectual crimes, etc.

  • (6)

    A person coexisting with any of the foregoing

  • (7)

    Another person equivalent to the foregoing

• 2. 

  Customer covenants that it and its family will not, and will not cause third parties to, engage in any of the following acts.

  • (1)

    Violent demands

  • (2)

    Improper demands that exceed legal liability

  • (3)

    Use of threatening language or violence in relation to transactions

  • (4)

    Spreading rumors or using fraudulent means or power to harm the reputation or obstruct the business of the Company

  • (5)

    Other acts equivalent to the foregoing

• 3. 

  If it has determined that Customer is suspected of being in violation of any of the items listed under the two paragraphs above, the Company may, without any notice or warning, immediately suspend the use of the Coke ON Wallet Balance or account by the person whom the Company suspects of being in violation, or otherwise stop the performance of all or part of the liabilities under all agreements between the Company and the Customer, including the agreement pursuant to these Terms, and may refuse to execute all or part of the agreements.

• 4. 

  If Customer is in violation of Paragraph 1 or Paragraph 2 (in this Article, the violating person is the “Relevant Person”) the Company may, without any notice or warning, immediately invalidate the Coke ON Wallet Balance held by the Relevant Person and close the account of the Relevant Person, and may suspend the performance of its duties under, or cancel, all or part of all agreements between the Company and the Relevant Person without bearing any liabilities.

• 5. 

  All liabilities of the Relevant Person to the Company (not limited to those pursuant to these Terms) shall automatically become immediately due and payable, and the Relevant Person shall pay the full amount of such liabilities to the Company immediately in cash.

• 6. 

  The measures pursuant to Paragraph 4 shall not preclude a claim by the Company for compensatory damages.

While the Company takes great care in the design and management of systems relating to Coke ON Wallet, the Company may temporarily suspend all or part of the contents of use of Coke ON Wallet without prior notice due to power outages, system outages, maintenance, security management to prevent improper use of Coke ON Wallet, etc., or other unavoidable circumstances. At that time, the Company shall have no liability for losses or damages incurred by Customer due to its inability to use Coke ON Wallet, except when there is willful misconduct or gross negligence by the Company.

Coke ON Wallet may not be subject to the creation of a pledge or other security interest. The Company shall have no liability even if Customer has incurred losses or damages due to Customer’s violation of this provision.

• 1. 

  The effective term of a Coke ON Money balance shall be until the end of the month after 36 months from the final deposit date or final use date, whichever is later.

• 2. 

  The effective term of Coke ON Points shall be until the end of the month after12 months from the date on which points were granted in principle; provided, however, that points with a separate expiration date shall expire once that period has lapsed. For the customer who have not registered Coke ON Wallet, the effective term of Coke ON Points shall be until the end of the following month from the date the points are granted. If such customer completes the registration during the validity period of those points, the expiration date of the points will be extended to the end of the month 12 months after the point grant date.

Customer may cancel the registration with Coke ON Wallet in the manner prescribed by the Company. In this case, Customer shall lose its position as Customer pursuant to these Terms (“Customer Qualification”) and shall no longer be able to use Coke ON Wallet after the period of time prescribed by the Company has passed. If Customer has not used the Coke ON Wallet Balance prior to such cancellation, the Company may make the Coke ON Wallet Balance zero, and will not provide a cash refund.
As Coke ON Wallet is a service integrated with Coke ON, only a user who has terminated the use of Coke ON App can withdraw from the Coke ON Wallet. Please see Article 6 of the Coke ON Terms of Use regarding termination of use of Coke ON App.

• 1. 

  The Company may amend these Terms as defines below.

  • (1)

    On the condition that these amendments are deemed in the best interest for the Customer.

  • (2)

    The amendment of the terms and conditions is not contrary to the original purpose of the contract established by these terms and is considered reasonable in light of the necessity for the change, the appropriateness of the content after the change, and other relevant circumstances pertaining to the amendment.

• 2. 

  If the Company intends to amend these Terms, a date upon which the revised terms will take effect shall be established. The Company shall notify Customer using the Coke ON App, a website relating to the Coke ON Wallet or push notifications, or any other method as prescribed by the Company. regarding the contents of the revised Terms and their effective date.

• 3. 

  These Terms shall be revised, and the revised Terms shall be effective between Customer and the Company, as of the effective date provided in the previous paragraph.

• 1. 

  These Terms shall be construed in accordance with the laws of Japan.

• 2. 

  These Terms have been made in the Japanese language and shall be interpreted pursuant thereto. Translations are for reference purposes only. If there is any discrepancy between the provisions of these Terms and a translation, the Japanese language version shall prevail.
